1.Acceptance of these terms
By creating an account, accessing, or using eAdvocate Diary (the Platform), you agree to be bound by these Terms & Conditions (these Terms). If you are using the Platform on behalf of a law firm, chamber or organisation, you represent that you have the authority to bind that entity, and “you” refers to both you personally and that entity.
If you do not agree to these Terms, you must not access or use the Platform. We may update these Terms from time to time; the “Last updated” date at the top always reflects the current version. Material changes will be notified through the Platform or by email before they take effect.
2.Who we are
The Platform is operated by eAdvocate Diary (“we”, “us”, “our”). References to “Platform” include the website, web application, APIs, mobile interfaces and all related services.
3.Who may use the Platform
The Platform is designed for practising legal professionals, including advocates enrolled with any State Bar Council in India, junior advocates, and support staff invited onto an advocate’s account. You must be at least 18 years of age and legally competent to enter a contract.
We reserve the right to suspend or terminate any account that we reasonably believe does not meet these eligibility requirements.
4.Your account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must:
- provide accurate, current and complete information during registration;
- promptly update your account details if they change;
- notify us immediately at eadvocatediary@gmail.com if you suspect unauthorised access;
- ensure that you log out at the end of each session on shared devices; and
- not share your account credentials with any other person.
We are not liable for any loss or damage arising from your failure to comply with the above obligations.
5.Licence to use the Platform
Subject to your compliance with these Terms and payment of any applicable subscription fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for the duration of your active subscription, solely for your internal professional legal practice.
What you may not do
- copy, modify, distribute, sell or lease any part of the Platform;
- reverse-engineer, decompile or disassemble the Platform, except to the extent expressly permitted by applicable law;
- use the Platform to build a competing product or service;
- use automated means (bots, scrapers) to access the Platform, except as expressly permitted by us; or
- remove, alter or obscure any proprietary notices on the Platform.
6.Subscriptions and payments
The Platform operates on a subscription model. Free-tier accounts are available with limited features; paid plans unlock additional capacity and functionality as described on the pricing page.
Pricing and billing
- Subscription fees are quoted in Indian Rupees (INR) and are exclusive of applicable taxes (including GST), which will be added at checkout.
- Fees are billed in advance on a monthly or annual cycle, depending on the plan you select.
- We may change pricing from time to time. We will give you at least 30 days’ notice before any price increase takes effect at your next renewal.
Payment processing
Payments are processed through our third-party payment gateway. Your card and UPI credentials are handled directly by the gateway; we never receive or store your full payment instrument details. By providing payment information, you authorise the gateway to charge the applicable fees.
Cancellation and refunds
- You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.
- You may export your data during the 30-day grace period after cancellation.
- Subscription fees are non-refundable except where required by applicable consumer protection law. If we discontinue a feature that was a material part of the plan you purchased, we will offer a pro-rata credit for the unused period.
7.Your content and data
You retain all ownership rights in the data, documents, case files and other content you create, upload or store on the Platform (Your Content). We do not acquire any ownership interest in Your Content.
By using the Platform, you grant us a limited, non-exclusive licence to host, store, index, display and transmit Your Content solely to the extent necessary to provide and improve the Platform for you. This licence terminates when you delete Your Content or close your account.
Your responsibilities for Your Content
You are solely responsible for ensuring that Your Content is lawful and does not infringe the rights of any third party. In particular, as an advocate, you must comply with your professional obligations under the Advocates Act, 1961, the Bar Council of India Rules, and any applicable court orders or undertakings regarding client confidentiality and data handling.
8.Requesting deletion of your data
You can request deletion of your account and all data associated with it at any time. To do so, email us at eadvocatediary@gmail.com with the subject line “Data Deletion Request”, using the email address registered to your account so that we can verify ownership.
- We will acknowledge your request within 24 hours.
- Deletion is irreversible: once carried out, your cases, hearings, clients, notes, documents and all other data in your account cannot be recovered.
- Requests are processed within 30 days of verification, after which residual copies may persist only in encrypted backups for up to 90 days, as described in our Privacy Policy.
- Where the law requires us to retain certain records (such as invoices and transaction data), those records are kept for the period required by law.
Prefer to do it yourself?
You can also delete your data directly from your account settings before requesting account closure. If you only want to remove specific cases or documents, you can delete them individually within the Platform without closing your account.
9.Acceptable use and conduct
You agree not to use the Platform to:
- upload or transmit malware, viruses or any code of a destructive nature;
- attempt to gain unauthorised access to any part of the Platform, other accounts, or any connected systems;
- interfere with or disrupt the Platform, servers, or networks;
- send unsolicited communications (spam) through the Platform;
- use the Platform in a manner that violates any applicable law, regulation, or professional ethical obligation;
- impersonate any person or entity; or
- collect or harvest personal data of other users without their consent.
We reserve the right to suspend or terminate accounts that violate this section, with or without prior notice where the violation is serious.
10.Service availability and support
We aim to keep the Platform available 24/7, but we do not guarantee uninterrupted access. Scheduled maintenance windows are published in advance where possible. We are not liable for any loss caused by downtime, however arising.
Support is available via email at eadvocatediary@gmail.com. We aim to respond to support queries within 24 hours during business days. Emergency support for critical issues (account lockout, data loss) is available around the clock.
11.Intellectual property
The Platform, including its design, code, database structure, logos, trademarks, documentation and all other intellectual property, is owned by or licensed to us and is protected by Indian and international intellectual property laws.
These Terms do not grant you any right, title or interest in the Platform other than the limited licence described in Section 5. Our name, logo and all related names, logos and marks are our trademarks; you may not use them without prior written consent.
12.AI-powered features
Certain features of the Platform may use artificial intelligence or machine learning models to provide functionality such as case analysis, summarisation or search enhancement. Where AI features are offered:
- Your Practice Data is not used to train, fine-tune or improve any AI model, whether ours or that of any third-party provider.
- AI-generated outputs are provided as aids only and do not constitute legal advice. You remain solely responsible for verifying any output before relying on it.
- We will clearly label AI-powered features within the Platform and, where applicable, disclose the use of third-party AI providers in this section.
13.Limitation of liability
To the maximum extent permitted by law, the Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
To the maximum extent permitted by law, eAdvocate Diary and its directors, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, goodwill or professional reputation, arising out of or in connection with your use of the Platform, however caused and under any theory of liability.
Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Platform shall not exceed the subscription fees you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.
Professional responsibility
The Platform is a practice management tool, not a substitute for professional legal judgement. You remain solely responsible for the conduct of your practice, the accuracy of your case records, compliance with court deadlines, and fulfilment of your professional obligations to your clients.
14.Indemnity
You agree to indemnify, defend and hold harmless eAdvocate Diary and its directors, employees and agents from and against any claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or professional obligation; or (d) Your Content.
15.Termination
Either party may terminate this agreement: you by cancelling your subscription and ceasing to use the Platform; us by disabling your account for material breach of these Terms, subject to reasonable notice and an opportunity to cure where the breach is capable of remedy.
Upon termination, your right to access and use the Platform ceases immediately. We will make Your Content available for export for a period of 30 days, after which it will be deleted in accordance with our Privacy Policy. Sections that by their nature should survive termination (including limitation of liability, indemnity, and governing law) will continue to apply.
16.Dispute resolution and governing law
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall first be resolved through good-faith negotiation between the parties.
If the dispute is not resolved within thirty (30) days of written notice, either party may refer the matter to arbitration under the Arbitration and Conciliation Act, 1996, to be conducted by a sole arbitrator mutually appointed by the parties, seated in Kanpur, Uttar Pradesh, and conducted in English.
Notwithstanding the above, either party may seek interim or injunctive relief from a court of competent jurisdiction to prevent irreparable harm.
17.Force majeure
Neither party shall be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay results from circumstances beyond its reasonable control, including natural disasters, acts of government, war, terrorism, pandemic, power failures, internet disruptions or failures of third-party services. The affected party must notify the other party promptly and use reasonable efforts to mitigate the impact.
18.General provisions
- Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Platform and supersede all prior agreements and understandings.
- Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
- Waiver. Failure by either party to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
- Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition or sale of assets, subject to notifying you.
- Notices. Notices to you may be sent by email to the address associated with your account or through the Platform. Notices to us must be sent to eadvocatediary@gmail.com.
